Evyatar Nitzany, a former manager at El Camino Hospital, has been charged with indecent exposure, false imprisonment, and intimately touching a nurse against her will at a retirement party. The nurse reported the incident to HR in late September 2024, but claims the hospital dismissed her complaint since it happened off premises. Court records indicate that the situation caused the nurse to have a mental breakdown in October 2024. 

On April 28, 2025, the nurse filed a lawsuit against both Nitzany and El Camino Hospital. Nitzany's lawyer maintains his innocence and claims he has no prior criminal record.

About The Lawsuit

On March 1, 2024, during a retirement party at Morton's Steakhouse in San Jose, it's alleged that Nitzany followed the nurse into the bathroom, kissed her, groped her, and demanded oral sex.

The nurse, who had known Nitzany professionally for three years, was understandably shaken. She reported the incident to the hospital's Human Resources months later, but they allegedly dismissed her complaint because it happened off hospital grounds. 

The Impact on the Victim and the Institution

The nurse filed a lawsuit against both Nitzany and El Camino Hospital, accusing them of not taking her report seriously. This is a stark reminder of how workplace harassment can have lasting effects on victims. According to a study, about 53% of nurses worldwide report experiencing sexual harassment at some point in their careers. 

El Camino Hospital's spokesman, Ross Coyle, stated that the hospital is taking the allegations seriously, but couldn't comment further due to the ongoing litigation. 

For healthcare organizations, this case serves as a reminder of the importance of clear policies regarding professional conduct at work-related social events and the need for thorough investigation of all reports of misconduct, regardless of where they occur.
